Dasso Statement on North American Operations

Hangzhou Dasuo Technology Co. Ltd. (Dasso) Concludes Annual Meeting By Issuing Statement on North American Operations

Hangzhou, China: Hangzhou Dasuo Technology Co. Ltd. (Dasso), one of the leading manufacturers and suppliers of bamboo products worldwide, issued a statement from its headquarters that may have a significant impact on the bamboo exterior decking industry in the United States. The announcement came after several days of meetings at the company’s world headquarters in Hangzhou, China during the week of April 16, 2018, with many high-ranking board members, executive officers and corporate representatives from Dasso, as well as Dasso’s expansive group of subsidiaries and affiliated entities, in attendance. A major topic discussed at the company’s board of director’s meeting concerned a former, terminated  factory manufacturing and selling counterfeited exterior bamboo decking product to distributors, who then mislead consumers, suppliers and dealers by claiming that the counterfeited product is manufactured at a Dasso contracted factory.

Of particular note, the statement released from Dasso identifies MOSO International, BV’s (MOSO) as one of the distributors involved in the scheme of purchasing counterfeited exterior decking product directly from Dasso’s former  factory and importing the counterfeited product into the United States, beginning in 2017. According to Lin Hai, the founder and Policy and Technical Advisor of Dasso, “It is of great importance that customers, distributors and dealers of our patented exterior decking product in the United States understand precisely where we, as a company, stand on these issues.” The statement released by Dasso is a “buyer beware”,  and notifies and warns consumers, dealers, distributors and retailers that the product being sold by MOSO in the United States under the brand name MOSO Bamboo X-treme1 is counterfeited product being manufactured and produced at an unauthorized and terminated former factory. The statement also makes clear that Dasso has not merged with MOSO, is not doing business as MOSO and is not selling product as or under the MOSO brand, including MOSO Bamboo-X-treme, in the United States market.

Steve Shen, Dasso’s Vice President, was quoted as saying: “In June 2017, MOSO’s President, Rene Zaal, made multiple trips to China and requested permission from Dasso to enter into the U.S. market as an authorized distributor of Dasso’s patented exterior decking product sold by MOSO in Europe as MOSO Bamboo X-treme. After Mr. Zaal’s request was repeatedly denied, Mr. Zaal struck a backdoor deal with a Dasso contracted factory and began buying Dasso’s patented product directly from the factory without authorization or consent, which violated the factory’s contract with Dasso, as well as MOSO’s restricted distribution contract with Dasso. When the factory refused to allow Dasso’s representatives into the factory for safety and product inspections and refused to cease selling the patented exterior decking product directly to MOSO, Dasso terminated the factory’s manufacturing agreement on September 18, 2017. Despite its termination, the factory continues to illegally manufacture exterior bamboo decking product using Dasso’s patented processes and Dasso is pursuing the former factory owner for criminal prosecution and civil damages in China. Further, MOSO continues to purchase the counterfeited exterior decking product from the terminated and former factory in violation of the laws of China, the United States. We, as a company, cannot allow a former factory to continue manufacturing counterfeited product in violation of Dasso’s patent rights; nor can we allow a distributor to strike a deal behind our backs with a now-former factory and claim the counterfeited product is genuine.”

The statement released from the company also includes a direct quote from Dasso’s Chief Executive Officer, Frank Xu: “Our biggest concern is, first and foremost, for the safety of each end-user of our patented products. Our entire company’s philosophy is built upon the customer’s experience and satisfaction. Secondly, it is imperative that Dasso’s patented product is manufactured in strict accordance with our patented processes to ensure the safety, integrity, dependability and reliability of our products sold worldwide. Each factory that manufactures our patented product is contractually required to adhere to stringent manufacturing guidelines, inspections and onsite visits. This is non-negotiable and strictly enforced. Dasso’s product warranties only apply and extend to genuine product manufactured by an authorized contracted factory and does not apply to counterfeited products being sold in the United States  under the brand name MOSO Bamboo X-treme. In those markets, the only genuine, authorized and approved exterior bamboo decking products that carry Dasso’s product warranties are sold under the dassoXTR brand by our U.S.-based affiliate, Easoon USA, LLC.”

Dasso’s CEO concluded the meetings by reviewing the company’s financials. According to Mr. Xu, Dasso, including its many subsidiaries and affiliated companies, is financially strong and viable and continue to exceed projections and expectations. In fact, 2017 was Dasso’s most profitable, with the current year’s first quarter already outperforming last year’s first quarter in revenue and sales. Mr. Xu outlined and detailed several new innovative products currently being developed, and updated the company on new products ready for production and distribution. With the annual increases in revenue and profitability, the company unanimously voted to establish a committee to begin the process of becoming a publicly listed company in the near future. After a week of meetings, factory tours and a celebratory dinner, the future looks bright for Dasso.

dasso Group Files Patent Infringement Lawsuit Against Moso North America

For Immediate Release

Nov. 07, 2017

dasso Group, the global innovator of moso bamboo products, has filed a lawsuit in federal court in Delaware, USA, against Moso North America for patent infringement of its patented Fused Bamboo product, which is sold in the United States under the dasso.XTR brand. In addition to patent infringement, dasso Group has also brought claims against Moso North America, Inc. for tortious interference with a contract and violation of Delaware’s Deceptive Trade Practices Act. Easoon USA, LLC is also listed as a plaintiff in the lawsuit against Moso North America, Inc., as dasso Group’s exclusive distributor of Fued Bamboo product in the United States. The case style is Dasso International, Inc. and Easoon USA, LLC v. Moso North America, Inc., in the United States District Court for the District of Delaware, Civil Action No. 1:17-cv-01574.

According to the lawsuit, dasso Group has learned that several former employees and its European distributor, Moso International BV, headquartered in the Netherlands, are involved and directly linked to the intentional infringement of dasso Group’s U.S. Patent in violation of the U.S. Patent Act. Further, details of the allegations against Moso North America, Inc., including dasso Group’s former employees and Moso International BV, were released in a previous press release.

dasso Group Issues Notice of Patent Infringement in U.S. Market

dasso Group, a global manufacturer and distributor of bamboo flooring, has issued a Notice of Patent Infringement of its patented Fused Bamboo product, which is sold in the United States under dasso’s XTR brand. According to the Notice of Patent Infringement, dasso Group has learned that several former employees and outside sales representatives, including a major bamboo flooring distributor headquartered in the Netherlands, are involved and directly linked to the intentional infringement of dasso Group’s U.S. Patent in violation of the U.S. Patent Act.

dasso Group’s Fused Bamboo is a patented process and manufacturing method, which has been granted patent protection in many countries around the world, including, but not limited to, the United States, the European Union (10 member states) and China. dasso Group’s U.S. Patent 8,709,578 was granted on April 29, 2014 and remains a valid and enforceable patent in the U.S. dasso Group’s patented Fused Bamboo products are sold and distributed exclusively in the U.S. under the brand name dasso.XTR and can be found on the company’s website at dassoXTR.com.

Beginning in 2013, as part of its global initiative to expand its sales channels and platforms, dasso Group granted Moso International BV the exclusive limited rights to distribute dasso Group’s patented Fused Bamboo exterior decking product, in certain countries in Europe, Asia, Africa and Latin America. Since 2013, Moso International BV has distributed dasso Group’s patented Fused Bamboo exterior decking under Moso’s Bamboo X-treme brand within and limited to the territories authorized by dasso Group.

According to dasso Group, in June 2017, Moso International BV’s Director of Operations, Rene Zaal, met with officers of dasso Group in China and requested an expansion into the U.S. market of its distribution rights of dasso Group’s patented Fused Bamboo products. After this request was denied, dasso Group has learned that Moso International BV privately entered into a manufacturing agreement with the same factory in China that has manufactured dasso Group’s patented Fused Bamboo products since 2013. dasso Group has also learned that several former employees of dasso Group, including Brett Kelly (who was the President of dasso.XTR), Steve Osterman and Mark Clifton, participated in and assisted Moso International BV’s plans to enter the U.S. market, in violation of its limited distributorship agreement with dasso Group and in violation of U.S. patent laws, and to sell dasso Group’s patented Fused Bamboo product under Moso International BV’s Bamboo X-Treme brand. Brett Kelly is now the President of MOSO North America, Inc.; Steve Osterman is now the Vice President of Sales at Moso North America, Inc; and Mark Clifton is now the Vice President and General Manager at Moso North America, Inc.

According to Avery Chua, dasso Group’s U.S. representative, “Moso International BV has never been granted the rights to distribute or sell dasso Group’s patented Fused Bamboo products in the United States. As part of our investigation, we have learned that Moso International BV, through its newly formed company, Moso North America, Inc., and with the assistance of dasso Group’s former employees, are now importing, selling and distributing dasso Group’s patented Fused Bamboo product in the U.S. under Moso’s Bamboo X-treme brand, which is the same brand and the same product that Moso International BV has been selling in limited territories since 2013. We are aware of the actions of our former employees and Moso International BV and we are preparing legal action against those employees and Moso North America, Inc. to enforce dasso Group’s U.S. patent and distribution rights and to hold those who have knowingly participated in these activities accountable.” dasso Group also announced that it will take all necessary actions to safeguard and protect the rights of its authorized distributors and dealers in the U.S. market.

dasso Group is represented by Scott R. Hoopes and the law firm of Mills & Hoopes, LLC in Atlanta, Georgia. Any information or documents concerning the unauthorized and infringing solicitation, sale and distribution of dasso Group’s patented Fused Bamboo products in the U.S. market by Moso International BV, Moso North America, Inc., Brett Kelly, Steve Osterman and Mark Clifton, including bamboo product being sold and distributed as Moso Bamboo X-treme or Bamboo X-treme, should be sent to info@dassoGroup.com or scott@millshoopeslaw.com.

New 7″ RainClad® Siding System Boasts High-End Look and Reduced Installation Costs

dasso.XTR announces the launch of its new 7″ RainClad® Siding System. Similar to the 6″ RainClad Siding System, the 7″ bamboo siding carries the same profile with exception that it is wider.

High-End, Expensive Look

  • The wider profile provides a high-end expensive look to the house.
  • Each of the dasso.XTR planks are end-matched with tongue and groove joints to give the siding a continuous uniform look, and every plank fits tightly into the next plank.

Reduced Installation Costs

  • 7″ bamboo siding also requires less fasteners per square feet, which reduces fastener cost.
  • Cutting of siding planks is not necessary until you get to the end of the wall which helps reduce waste and speeds up installation time.

Coupled with the 7″ siding, dasso is also offering a new installation system for the wall siding with a track and fastener system. The track enables installers to level the planks once every 6 feet.
